Terms of Service
By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.
Acceptance of Terms. By accessing or using the Site, you agree to the terms of this Agreement. We may make changes to this Agreement from time to time in our sole discretion, and we may notify you of such changes by any reasonable means, including without limitation, by posting the revised version of this Agreement on the Site. You can determine when we last changed this Agreement by referring to the "LAST UPDATED" legend above. When using any Services (as defined below), you agree that you are subject to any additional posted guidelines, rules, terms and conditions applicable to such Services, which are hereby incorporated by reference into this Agreement. Your access to or use of the Site following changes to this Agreement will constitute your acceptance of those changes. Notwithstanding the foregoing, any changes to this Agreement shall not apply to any dispute between you and us arising prior to the date of such posting or other notification. We may, at any time, temporarily or permanently modify or discontinue all or part of the Site, with or without notice; charge fees in connection with the use of the Site; modify and/or waive any fees charged in connection with the Site; and/or offer opportunities to some or all users of the Site.
Description of Service
Copyright, Licenses and User Submissions
The entire contents of the Service are protected by international copyright and trademark laws and other proprietary rights. The owners of the copyrights and trademarks are Build Teach Learn, its affiliates and/or other third party licensors. YOU MAY NOT MODIFY, COPY, REPRODUCE, REPUBLISH, UPLOAD, POST, TRANSMIT, OR DISTRIBUTE, IN ANY MANNER, THE MATERIAL ON THE SERVICE. You may print and download portions of material from the different areas of the Service solely for your own non-commercial use provided that you agree not to change or delete any copyright or proprietary notices from the materials, and not to share any material that you paid for with anyone else who has not also purchased a license for that material.
You may not use or copy any content or data on or related to the Service in a manner not authorized by Build Teach Learn in writing. You may not engage in practices of obtaining lists of users, portions of a database, or other lists or information from the Service, in any manner and any quantities not authorized by Build Teach Learn in writing.
Content submitted by users for inclusion on the Service (including, without limitation, any information submitted on the community PLC, discussion forums or other public areas of the Service) is sometimes referred to in these Terms of Service as “User Submissions.” Whether or not any User Submission is published, it will be subject to these Terms of Service. Build Teach Learn does not guarantee any confidentiality with respect to a User Submission, regardless of whether or not it is published. You are solely responsible for your own User Submissions and the consequences of posting or publishing them. You represent and warrant that you own or have the necessary licenses, rights, consents and permissions to your User Submissions (and all content included therein), including the right to authorize Build Teach Learn to use the User Submissions in the manner contemplated by the Service and these Terms of Service.
You hereby grant to Build Teach Learn a non-exclusive, royalty-free, worldwide, perpetual license, with the right to sub-license, to reproduce, distribute, transmit, create derivative works of, publicly display and publicly perform any User Submissions or any other materials or information (including, without limitation, ideas for new or improved products or services) you communicate to Build Teach Learn by all means and in any media now known or hereafter developed. You also grant to Build Teach Learn the right to use your name in connection with the submitted materials and other information as well as in connection with all advertising, marketing and promotional material related thereto. You agree that you shall have no recourse against Build Teach Learn for any alleged or actual infringement or misappropriation of any proprietary right in your communications to Build Teach Learn.
We neither endorse nor assume any liability for the contents of any User Submission. We have the right to remove any User Submission or other content that, in our judgment, does not comply with these Terms of Service and any other rules of user conduct for the Service, or is otherwise harmful, objectionable, or inaccurate. We are not responsible for any failure or delay in removing any such User Submission or other content. You hereby consent to such removal and waive any claim against us arising out of such removal of any User Submission, whether it is your own or another user’s. See “Copyrights, Licenses and User Submissions” above for a description of the procedures to be followed in the event that any party believes that a User Submission infringes on any patent, trademark, trade secret, copyright, right of publicity, or other proprietary right of any party.
Build Teach Learn will not tolerate violations of intellectual property rights on the Service. If you are a copyright owner and believe that any User Submission or other content infringes upon your copyrights, you may submit a notification pursuant to the Digital Millennium Copyright Act (“DMCA”). To provide BTL notice of an infringement, you must provide a written communication to the attention of “DMCA Infringement Notification Dept.” care of email@example.com that sets forth the information specified by the DMCA (see http://www.copyright.gov/title17/92chap5.html#512). You may be liable for damages (including costs and attorneys' fees) if you materially misrepresent that an activity is infringing your copyright.
The following terms apply to your use of the Service and any account that you may open or attempt to open via the Service: You represent and warrant that you are at least 18 years of age. If you are under age 18, you may not, under any circumstances or for any reason, use the Service as a teacher or course builder. You must be a human to open an account. Accounts registered by “bots” or other automated methods are not permitted. You are responsible for maintaining the security of your account and password. We view any actions taken by your account as taken by you. Build Teach Learn will not be liable for any loss or damage from your failure to comply with this security obligation. You are responsible for all activity and content such as videos, files, data, graphics, photos and links that is uploaded under your Build Teach Learn account (“Course Content”). You must not transmit any worms or viruses or any code of a destructive nature. The person signing up for the BTL Service is responsible for the account and is bound by these Terms of Service. If you signup on behalf of your employer, your employer owns the account and is also bound by our Terms of Service.
We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
We reserve the right, at any time, to change any fees or charges for using any services provided on the Service (or to begin charging fees for any free service), provided that such changes will not apply to fees or charges paid or free services used prior to the time of the change.
Links To Other Web Sites
Our Service may contain links to third-party web sites or services that are not owned or controlled by Build Teach Learn. BTL has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that Build Teach Learn shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.
Rules for All Users
Build Teach Learn is a community of teachers. When you sign up for the Site, you agree to the following rules: You will use the Service only for lawful purposes and agree to not use the Service in any way that will infringe upon the use or rights of any other user. Your use of the Service is subject to all applicable laws and regulations, and you are solely responsible for the substance of your communications through the Service. You will not upload any copyrighted, trademarked, or proprietary materials on the Service without the expressed permission of the owner. You will not post any content that infringes on any patent, trademark, trade secret, copyright, right of publicity, or other intellectual property or proprietary right of any party. You assume full responsibility for the content of the Service offered. You understand that classes posted are publicly available to be viewed and accessed by any student. You agree that you will not engage in any behavior that constitutes unauthorized or unsolicited advertising, junk or bulk email (also known as “spamming”), chain letters, any other form of unauthorized solicitation, or any form of lottery or gambling. You will not share content from the Service with anyone who is not properly licensed to access the content. You will not upload, share, post, distribute or otherwise partake in any behavior that is unlawful, threatening, abusive, harassing, defamatory, libelous, deceptive, fraudulent, invasive of another’s privacy, tortious, contains explicit or graphic descriptions or accounts of sexual acts (including but not limited to sexual language of a violent or threatening nature directed at another individual or group of individuals), or otherwise violates our rules or policies. You will not partake in any behavior that victimizes, harasses, degrades, or intimidates an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability. You will not share software viruses or any other computer code, files, or programs that are designed or intended to disrupt, damage, or limit the functioning of any software, hardware, or telecommunications equipment or to damage or obtain unauthorized access to any data or other information of any third party. You will not impersonate any person or entity, including any of our employees or representatives. You will not use your account to breach security of another account or attempt to gain unauthorized access to another network or server. Not all parts of the Service may be available to you or other authorized users of the Service. You shall not interfere with anyone else’s use and enjoyment of the Service. Users who violate systems or network security may incur criminal or civil liability.
Specific Rules Course Creators
When you publish a class on the Site, you agree to the following rules: You will honor any enrollments and obligations to BTL in support of your teachers users. You grant us the right to place advertisements on your content at our sole discretion. Any content you submit to the Service will not contain third party copyrighted material, or material that is subject to other third party proprietary rights, unless you have permission from the rightful owner of the material. You represent and warrant to Build Teach Learn that you are qualified to teach the classes that you list with the Service and that you will at all times conduct yourself in a professional manner and in compliance with all applicable laws. You understand that, if you teach a class, your teachers will have the ability to post a review of this class. We cannot control the contents of any such review and will not be held responsible for any information or opinions that a user may include in any such review. You may choose to remove content from your class and will continue to own such content, but we will continue to have the right to use that content and to provide it to teachers who have paid for or enrolled in your class. You grant us full ownership of any video content that we have filmed for you. It is at our sole discretion to remove, add, or edit that video content. Build Teach Learn reserves the right to, but is under no obligation, to delete the listing of any class at any time and for any reason.
Specific Rules for Teachers
When you enroll in a course on the Site, you agree to the following rules: You will accept all of the terms and conditions including the cancellation policy listed in the Service when you agree to enroll in or access a class on Build Teach Learn. You will follow all reasonable rules set by the course creator with respect to a class, and you will not take any actions to interfere with the course creator or any other teachers in the course discussions or PLCs. You may access class content for your information and personal use only. You will not interfere with any course creator's ongoing relationship with any teachers participating in a course or PLC. BTL reserves the right to delete or suspend your account if you violate any of our rules, or at any time and for any reason
When a teacher takes a class on Build Teach Learn, we will share the teachers username and profile with the course creator. After enrolling in a class on BTL, a teacher grants to us permission to share that teacher information with the course creator. The course creator is required to respect the privacy of the teacher. The course creator has a limited license to use this information only for Build Teach Learn-related communications or for Build Teach Learn-facilitated transactions. The course creator may use that personal information for no other purpose, such as sending unsolicited commercial messages or unauthorized transactions. Without express consent from that person, you must not add any Build Teach Learn misuse any student’s personal information. Remember that you need to comply with all relevant legal rules when you use Build Teach Learn.
Course Creation or Participating in a Course
Teaching or participation in a course is at your sole risk. BTL does not supervise classes and is not involved in any way with the actions of any individuals (whether teachers or course creators) at any class. As a result, we have no control over the identity or actions of the individuals who are present at these courses, and we request that our users exercise caution and good judgment when participating in courses.
BTL collects all fees and pays out all teachers through third party providers. Each provider is its own company, and BTL isn’t responsible for its performance. No refunds are offered for BTL course and subscription fees or any other fees collected by the Service. Fees for BTL courses or any other portion of the Service may be changed at any time without prior notice.
Course Creator Payments
Course Creator may earn revenue by publishing classes or offering additional services through BTL. BTL pays course creators “BTL Builders” after payment has been made by users. Payouts sent on the 28th of each month are for transactions that have occurred in the previous calendar month. BTL distributes 40-60% of its monthly recurring revenue to course creators on a monthly basis. Course Creators have 30 days from the time at which a payment was or should have been made to report any discrepancies. After 30 days, you have waived your right to dispute any payment. Course Creators are responsible for all income, sales, and other taxes associated with the fees they earn. Course creators will receive the appropriate tax forms, such as a 1099 or 1099k, from either BTL or one of its payment partners. BTL reserves the right to withhold any payment until it has received all tax identification information it requires to satisfy its obligations. BTL reserves the right to withhold or cancel payments to a course creator if it deems, in its sole judgement and absolute discretion, that the course creator engaged in behavior that violated any part of this Agreement.
All users who sign up may participate in the “Referral Program” by referring potential teachers to the Service. Under the Premium Referral Program, you will receive 10% of the sale for a teacher who signs up for a course. You will receive this reward within 40 days of the teacher paying for a course, subscription, or bundle.
In order to receive a Referral payment, each of the following requirements must be met: (1) you must log in to your BTL account on the Service and locate your “Referral Link”; (2) you must share the BTL referral Link generated by BTL with friends, family, and followers; (3) a teacher who clicks your Referral Link must pay for a course for the 10% commission award. (4) The teacher must sign up with a .edu or school based email account. Non school accounts will not be accepted.
Cancellations and Refunds
BTL is not responsible or liable for any refunds for subscriptions, workshops, or other purchases on the Service.
BTL Subscription Membership
You may participate in our “BTL Subscription” by subscribing to pay annual membership fees for up to 40 weeks worth of course content.
The membership fee will be billed on the beginning of the paying portion of your membership and each year or year thereafter unless and until you cancel your membership. We automatically bill your Payment Method year on the calendar day corresponding to the commencement of your paying membership. We reserve the right to change the timing of our billing, in particular, as indicated below, if your Payment Method has not successfully settled.
Payments are nonrefundable and there are no refund or credits for partially used periods. Following any cancellation, however, you will continue to have the benefits of your BTL Membership through the end of your current billing period.
You may cancel your BTL Membership at any time for any or no reason. To cancel your recurring subscription, please visit your payment settings within your BTL account profile located at https://www.buildteachlearn.com/account. If you have canceled your BTL Membership, you will lose access to all features and courses you enrolled into during your BTL Membership at the end of your billing period. If you choose to sign back up as a paying member, your billing date will reset to the day you paid.
From time to time, we or others on our behalf may offer trials for a specified period without payment or at a reduced rate (a “Trial”). BTL reserves the right, in its absolute discretion, to determine your eligibility for a Trial, and, subject to applicable laws, to withdraw or to modify a Trial at any time without prior notice and with no liability, to the greatest extent permitted under the law.
Build Teach Learn Rights
Build Teach Learn reserves these rights: We can make changes to the BTL Site and Services without notice or liability. We have the right to terminate your membership, account, payment, or other affiliation with the Service at any time and for any reason. We can change our eligibility criteria at any time. If these things are prohibited by law where you live, then we revoke your right to use BTL in that jurisdiction. We will cooperate fully with investigations of violations of systems or network security at other sites, including cooperating with law enforcement authorities in investigating suspected criminal violations.
We have the right to remove a teacher from the Partner Program at any time, without prior notice, at our sole discretion, should we identify that their account is associated with behavior that we deem to be in violation of our rules or guidelines. We have the right to reject, cancel, interrupt, remove, or suspend any class, comment, or other posted comment at any time and for any reason. BTL is not liable for any damages as a result of any of these actions, and it is our policy not to comment on the reasons for any such action.
Content available through the Service or presented at any class represents the opinions and judgments of an information provider, user, or other person or entity not connected with us. We do not endorse, nor are we responsible for the accuracy or reliability of, any opinion, advice, or statement made by anyone other than an authorized Build Teach Learn spokesperson speaking in his/her official capacity.
The courses offered on BTL are offered directly by the teachers & course creators. BTL is not responsible or liable for any information on its Service listings or profiles. BTL is not responsible for any changes made to a class by the teacher.You understand and agree that temporary interruptions of the Service may occur as normal events. You further understand and agree that we have no control over third party networks you may access in the course of the use of the Service, and therefore, delays and disruption of other network transmissions are completely beyond our control. You understand and agree that the Service is provided “AS IS” and that we assume no responsibility for the timeliness, deletion, mis-delivery or failure to store any user communications or personalization settings.
Limitation of Liability
THE COMPANY PARTIES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY OR PUNITIVE DAMAGES OF ANY KIND, UNDER ANY CONTRACT, NEGLIGENCE, STRICT LIABILITY OR OTHER THEORY, INCLUDING WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OR INTERRUPTION OF BUSINESS, LOSS OF USE, DATA, LOSS OF OTHER INTANGIBLES, LOSS OF SECURITY OF INFORMATION YOU HAVE PROVIDED IN CONNECTION WITH YOUR USE OF THE SITE, OR UNAUTHORIZED INTERCEPTION OF ANY SUCH INFORMATION BY THIRD PARTIES, EVEN IF ADVISED IN ADVANCE OF SUCH DAMAGES OR LOSSES. IN PARTICULAR, AND WITHOUT LIMITATION, THE COMPANY PARTIES WILL NOT BE LIABLE FOR DAMAGES OF ANY KIND RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SITE OR FROM ANY CONTENT POSTED ON THE SITE BY COMPANY OR ANY THIRD PARTY. YOUR SOLE AND EXCLUSIVE REMEDY FOR DISSATISFACTION WITH THE SITE IS TO STOP USING THE SITE. THE MAXIMUM LIABILITY OF THE COMPANY PARTIES FOR ALL DAMAGES, LOSSES AND CAUSES OF ACTION, WHETHER IN CONTRACT, TORT (INCLUDING WITHOUT LIMITATION NEGLIGENCE) OR OTHERWISE, SHALL BE TWENTY-FIVE U.S. DOLLARS (USD $25).
Applicable law may not allow for limitations on certain implied warranties or exclusions or limitations of certain damages; solely to the extent that such law applies to you, some or all of the above disclaimers, exclusions or limitations may not apply to you, and you may have additional rights.
While we try to maintain the integrity and security of the Site and the servers from which the Site is operated, we do not guarantee that the Site will be or remain secure, complete or correct, or that access to the Site will be uninterrupted. The Site may include inaccuracies, errors and materials that violate or conflict with this Agreement. Additionally, third parties may make unauthorized alterations to the Site. If you become aware of any unauthorized third party alteration to the Site, contact us at firstname.lastname@example.org with a description of the material(s) at issue and the URL or location on the Site where such material(s) appear.
